1. Acceptance of these terms
These Terms of Use are a binding agreement between you and Gentle Systems, Inc., which operates the Gentle Weapons website. They govern your access to and use of gentleweapons.com and related pages that link to these terms, collectively called the “Site.” By accessing or using the Site, you agree to these terms and our Privacy Policy. If you do not agree, do not use the Site.
If you use the Site for a company, government body, or other organization, you represent that you have authority to accept these terms for that organization. In that case, “you” includes both you and the organization.
2. These terms cover the public site
The Site provides public information about Gentle Weapons, GWOS, Poolnet, Poolboy, and related capabilities. These terms do not grant access to any product, source code, technical data, pilot, support service, or deployment environment. Product evaluations, pilots, licenses, services, and confidential disclosures require a separate written agreement. If that agreement conflicts with these terms regarding the covered product or service, the separate agreement controls.
3. Permitted use
Subject to these terms, Gentle Weapons grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for lawful informational and internal business purposes. You must comply with applicable laws and must not:
- Interfere with, disrupt, damage, or probe the Site or its supporting systems.
- Bypass access controls, rate limits, or other technical restrictions.
- Introduce malware or use the Site to transmit unlawful or harmful material.
- Misrepresent your identity, affiliation, authority, or intended use.
- Use automated means that impose an unreasonable load or evade published controls.
- Use Site content in a way that infringes intellectual property or other rights.
We may suspend or block access when we reasonably believe it is necessary to protect the Site, our users, our rights, or other parties.
4. Communications and restricted information
You are responsible for information you submit through the Site or by ordinary email. You represent that you have the right to provide it and that doing so does not violate law, contract, policy, or another person’s rights.
The public briefing form and ordinary email are not approved systems for classified information, Controlled Unclassified Information, export controlled technical data, source selection information, or other regulated or restricted material. Do not submit that information. Contact Gentle Weapons first to arrange an approved communication method when one is needed.
A submission does not create a confidential, fiduciary, teaming, employment, agency, or customer relationship. Our Privacy Policy still governs personal information in your submission. Any separate confidentiality obligation must be stated in a written agreement signed by an authorized Gentle Weapons representative.
5. Intellectual property
The Site, including its text, graphics, logos, designs, software, product names, and other content, is owned by Gentle Weapons or its licensors and is protected by intellectual property laws. Except for the limited right in Section 3, no right or license is granted by implication, estoppel, or otherwise. You may not copy, modify, distribute, publicly display, create derivative works from, or commercially exploit Site content without prior written permission or an applicable legal exception.
If you voluntarily provide feedback or suggestions about the Site, you grant Gentle Weapons a worldwide, perpetual, irrevocable, royalty free right to use and incorporate that feedback without restriction or compensation. Do not provide feedback that you lack authority to license on those terms.
6. Public information and product availability
Site content is a public overview and may describe planned, developmental, limited pilot, or preproduction capabilities. Availability, technical specifications, performance, readiness, certifications, compliance status, roadmaps, and release timing may change. Site content does not constitute a proposal, quote, offer for sale, procurement commitment, technical warranty, certification, authorization, or guarantee of future availability.
You should not rely on the Site as the sole basis for operational, safety, security, procurement, compliance, or deployment decisions. Confirm applicable requirements and current product details through an authorized representative and the governing written agreement.
7. Export controls and sanctions
You must comply with applicable United States and other export control, sanctions, and trade laws. Access to public Site content does not authorize any export, reexport, transfer, release, or provision of a defense service, controlled software, or controlled technical data. Product access and nonpublic technical disclosures may be limited by nationality, location, end user, and end use, and may require government authorization.
8. Third party content and services
The Site may link to or reference third party websites, products, standards, platforms, or organizations. Those references do not mean that Gentle Weapons controls or endorses the third party. Third party services have their own terms and privacy practices, and you use them at your own risk.
9. Disclaimers
To the maximum extent permitted by law, the Site is provided “as is” and “as available.” Gentle Weapons disclaims all express and implied warranties concerning the Site, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and freedom from harmful components. We do not warrant that the Site will be uninterrupted, error free, or suitable for any particular decision or use.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Gentle Weapons and its officers, directors, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities, arising from or related to the Site.
To the maximum extent permitted by law, their total aggregate liability arising from or related to the Site will not exceed one hundred United States dollars. These limitations apply regardless of the legal theory and even if a party was advised that damages were possible. They do not exclude liability that cannot legally be limited.
11. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Gentle Weapons and its officers, directors, employees, contractors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your unlawful use of the Site, your violation of these terms, or information you submit in violation of another party’s rights. This section does not apply to the extent a claim results from Gentle Weapons’ own unlawful conduct.
12. Governing law and disputes
Arizona law governs these terms and any dispute concerning the Site, without regard to conflict of laws principles. Subject to any nonwaivable law, the state and federal courts located in Maricopa County, Arizona, have exclusive jurisdiction, and you consent to their personal jurisdiction and venue.
13. Changes to the Site or terms
We may modify, suspend, or discontinue any part of the Site. We may also revise these terms by posting an updated version and changing the effective date. Changes apply prospectively when posted unless applicable law requires additional notice. Continued use after a revision means you accept the revised terms.
14. General terms
These terms and the Privacy Policy are the entire agreement concerning the public Site. If any provision is unenforceable, it will be modified only as much as needed, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these terms without our written consent. We may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Site or our business.
